Terms of sale

1. General provisions

1.1. These Terms of Sale (the Terms) govern the legal relationship between the owner of the hendrik.diy online shop (the Shop) and the person making a purchase (the Customer) when goods are purchased from the Shop.
1.2. The owner and seller of the Shop is Hendrik DIY OÜ, registration number 17554091, email hello@hendrik.diy (the Seller).
1.3. In addition to the Terms, the legal relationships arising from purchases in the Shop are governed by the legislation in force in the Republic of Estonia, in particular the Law of Obligations Act and the Consumer Protection Act.
1.4. The Seller has the right to change the Terms. The Terms published in the Shop at the moment the order is placed apply to the Customer.

2. Prices

2.1. All prices displayed in the Shop are in euros. The Seller is not registered for VAT, so no VAT is added to the prices.
2.2. The unit price may depend on the quantity ordered. The applicable unit price and quantity-based price tiers are shown on the product page, with the final price shown in the cart before the order is confirmed.
2.3. A delivery fee is added according to the selected delivery method. The delivery fee is shown to the Customer before payment.
2.4. The Seller has the right to change prices at any time. The price displayed at the moment the order is placed applies to the Customer.

3. Placing and paying for an order

3.1. To place an order, the Customer adds the desired products to the cart, selects a delivery method, enters the required details and pays for the order.
3.2. Payments are processed by Montonio Finance UAB. You can pay by online bank payment or bank card. Payment processing takes place in a secure environment outside the Shop, and the Seller has no access to the Customer’s bank or card details.
3.3. The sales contract is concluded once the order amount has been credited to the Seller’s bank account. The Customer receives an order confirmation by email.
3.4. If an ordered product cannot be delivered, the Seller may cancel the order and will notify the Customer as soon as possible. The amount paid will be refunded no later than 14 days to the same bank account from which the payment was made.

4. Delivery

4.1. Products are delivered within Estonia to the parcel locker selected by the Customer. The delivery fee is shown at checkout; for larger quantities, delivery may be free under the terms published in the Shop.
4.2. Products are made in the Seller’s workshop, and the delivery time depends on the production schedule. The estimated delivery time is published in the Shop and/or stated in the order confirmation. If the delivery time increases significantly, the Seller will notify the Customer by email.
4.3. When the parcel arrives at the parcel locker, the Customer receives a notification from the delivery service provider sent to the phone number provided by the Customer.
4.4. The Customer undertakes to provide correct contact details when placing the order. The Seller is not liable for delivery delays caused by inaccurate details provided by the Customer.

5. Right of withdrawal

5.1. A Customer who is a consumer has the right to withdraw from the sales contract without giving a reason within 14 days of receiving the goods.
5.2. To exercise the right of withdrawal, the Customer must send a withdrawal notice to hello@hendrik.diy within 14 days of receiving the goods, stating the order number and the bank account number to which the refund should be made.
5.3. The Customer must return the goods without delay, but no later than 14 days after submitting the withdrawal notice. The Customer bears the direct cost of returning the goods.
5.4. The returned product must be unused, undamaged and complete. The Customer may examine the product only as necessary to establish its nature, characteristics and functioning. If the product’s condition has deteriorated beyond this, the Customer is liable for the reduction in value, and the Seller may reduce the refund accordingly.
5.5. The Seller will refund all amounts paid by the Customer, including the delivery fee (except additional costs arising from a delivery method chosen by the Customer that is more expensive than the standard option), no later than 14 days after receiving the withdrawal notice, but not before the Customer has returned the goods or provided proof of return.

6. Complaints

6.1. The Seller is liable for a product’s non-conformity with the contract that becomes apparent within two years of the goods being handed over to the Customer. A defect that appears within the first year is presumed to have existed at the time the goods were handed over.
6.2. If a defect appears, the Seller must be notified no later than two months after it is discovered by sending a description and, if possible, photos to hello@hendrik.diy.
6.3. In the case of a defective product, the Customer has the right to demand repair or replacement of the product, a price reduction or withdrawal from the contract in accordance with the Law of Obligations Act.
6.4. Damage is not considered a defect if it was caused by improper use, lack of maintenance or external mechanical impact (for example, damage caused by a lawnmower or trimmer).

7. Use of the product and liability

7.1. The product is a weatherproof bait station (slug trap) for holding a slug control product and bait. Neither the slug control product nor the bait is included.
7.2. When using a slug control product, follow the manufacturer’s instructions and safety requirements. The product’s user guide is included with every order.
7.3. The Seller is not liable for damage caused by improper use of the product or the slug-control product.

8. Processing of personal data

8.1. The processing of personal data is described in the privacy policy, available at hendrik.diy/privaatsuspoliitika.

9. Resolving disputes

9.1. For questions or complaints, contact hello@hendrik.diy. The Seller will respond to complaints within 15 days.
9.2. If the Customer and Seller cannot reach an agreement, the Customer may refer the matter to the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority (ttja.ee) or to the county court. The European Union’s online dispute resolution platform at ec.europa.eu/consumers/odr may also be used.
9.3. These Terms are governed by the law of the Republic of Estonia.
